HRERA’s Strong Action in Gurugram: Strict Orders and Penalties for Delays by Builders

Major Move by Haryana RERA
The Haryana Real Estate Regulatory Authority (HRERA) has taken decisive action against several developers in Gurugram, bringing long-awaited relief to homebuyers who have been waiting for their flats for years. HRERA’s orders include strict directions and penalties for builders who have delayed possession and violated commitments, reflecting a strong stance on transparency and accountability in real estate.

Raheja Developers Case
In the case of Raheja Shilas in Sector 109, Delhi-based buyers Dharmapal Singh and Manjit Kaur booked a flat in 2010, paying nearly INR 66 lakh out of a total cost of INR 74 lakh. However, despite this payment, possession was not granted. HRERA has now ordered Raheja Developers to deliver possession within 90 days and compensate the buyers with interest for the delay.

Ramprastha Developers Case
For the Primera Society project in Sector 37D, Dwarka residents Vijay Kumar and Sonali Rajak booked a flat in 2013 and paid INR 1 crore, expecting possession by 2018. When they failed to receive it, HRERA ordered Ramprastha Developers to pay an interest of 11.10% per annum from February 2018 until possession is granted, a move aimed at compensating buyers for financial losses.

Tashi Land Developers Case
Sushma Rani, who booked a flat in Capital Gateway, Sector 111, paid INR 76 lakh but did not receive possession. In response, HRERA directed Tashi Land Developers to pay 11.10% annual interest from 2015 onward. HRERA also warned of legal action if compliance is not ensured within 90 days.

Sunrage Heights Case
In the 63 Golf Heights project, Sector 63A, buyer Ruchika Yadav from Gurugram paid INR 13.49 lakh but was left without possession in 2021. HRERA has instructed the developer to provide possession within 90 days and pay interest, offering significant relief to the affected buyer.

Other Stringent Actions by HRERA
Recently, HRERA has also taken similar action against other developers, including canceling the registration of five projects by Mahira Group, affecting around 5,000 buyers. HRERA emphasized that these steps were taken to ensure justice for homebuyers. Additionally, fines were imposed on BPTP Group for contract violations and excessive charges on buyers, while Vatika Group faced penalties for delayed possession.

HRERA’s strong measures are likely to have a far-reaching impact on the real estate sector in Haryana. These actions signal to developers that failure to follow regulations will attract strict consequences.
